Court acquits jawan of wife's murder

PUNE: A special court for women has acquitted a jawan who allegedly strangled his wife to death at their residential quarter in Ghorpadi in 2012 on the grounds that the Pune police had failed to conduct proper investigations in the case.

The court of special judge Prachi P Kulkarni passed severe strictures on police for arresting the jawan, Samadhan Kisan Jadhav (32), without having any evidence.

The prosecution's case is that Jadhav, who is a naik at the artillery division of the army and a resident of K G Lines Army servant quarters in Ghorpadi, allegedly strangled his wife Pratibha before going to work on July 14, 2012. Jadhav later tried to mislead the police by claiming that he found his wife lying unconscious in the bathroom when he returned in the evening.

The prosecution said Jadhav rushed her to the army hospital, where she was declared dead. The murder came to light after the post mortem of Pratibha's body at the army hospital. The report said that Pratibha had died due to strangulation. Jadhav was arrested and a chargesheet was filed against him.

The case came up for hearing before the special court. The prosecution relied on the evidence of six witnesses and submitted that the jawan was present at home when he had allegedly murdered his wife.

Jadhav's lawyer Sudhir Shah argued that the evidence shows that Jadhav performed night duty before the incident between 9pm and 6am.

Shah contended that Jadhav returned his rifle and reached home after purchasing milk and found his wife lying near the toilet between 6.30am and 6.40am. Shah told the court that Jadhav rushed Pratibha to the nearby Command hospital with the help of his neighbours where the doctors declared her dead on arrival.

He cited evidence of the neighbours and the victim's family members to prove that the relation between the couple was cordial and that he had no motive to kill her. Shah took a defence that she had died an accidental death while plugging loopholes in the prosecution's evidence that he was falsely implicated in the case.

In her judgment on February 3, Kulkarni observed that the police have taken action against the jawan even though there was no evidence against him and described the act as highly objectionable for failing to arrest the real persons involved in the crime.


The judge has sent a copy of the judgment to the police commissioner and prosecution department for taking necessary action
