Person not named in FIR can be tried if evidence crops up: SC

PTI | Jan 10, 2014, 01.06 PM IST

NEW DELHI: The Supreme Court on Friday held a person can be made an accused by the trial court in case evidence crops up during the proceedings even if he has not been named in the FIR or chargesheet.

A five-judge Constitution Bench headed by Chief Justice P Sathasivam said that the trial court has powers to summon a person as an accused despite his name being not mentioned by the investigators in the FIR and chargesheet.

The bench clarified that Section 319 of Criminal Procedure Code empowers the trial court to proceed against a person who appears to be guilty of offence but not named in the FIR or charge sheet.

The judgment could have implications in some cases arising out of the 2G scam in which the trial judge had summoned as accused some corporate honchos despite they being not named by CBI in the FIR and charge sheet.

The businessmen have approached the Supreme Court against the trial court's summoning order. The apex court is yet to pronounce its verdict in the case.

HC refuses to end marriage under Hindu Act

Shibu Thomas,TNN | Jan 10, 2014, 06.51 AM IST

MUMBAI: A decade after a Mulund resident went against her parents' wish and married her childhood sweetheart, a Christian, the Bombay high court has dismissed her plea to annul the marriage under the Hindu Marriage Act.
A division bench of justices Vijaya Kapse Tahilramani and V L Achliya said the Act is applicable only when both the spouses are Hindus.

"The provisions of Hindu Marriage Act can be applicable when both the spouses are Hindus and their marriage is performed according to Hindu rites. The marriage has to be valid within the meaning of the Act. It is also necessary that at the time of filing a divorce petition, both the spouses are Hindus by religion, except if one of them is seeking divorce on the grounds that the other person had converted to another religion," said the bench while upholding a family court order, refusing to entertain a petition filed by Nilanjana Simha seeking her marriage to Rajesh D'Souza be declared null and void under the Hindu Marriage Act.

The court said Rajesh, who is now settled in Hyderabad, was a Christian at the time of the marriage and is still one.

Nilanjana claimed she married Rajesh under Hindu rituals in 1999. Her last-ditch plea to the court that her husband had concealed the fact he was a Christian was also thrown out. The judges pointed out that in her petition she had said her parents had opposed their wedding sine they belonged to different religions. The HC further referred to Rajesh's surname, (D'Souza), "which is distinctly Christian and can never be a Hindu surname".

"Not only (Nilanjana) mentioned in the divorce petition that she did not know at the time of the marriage that Rajesh was not a Hindu but it is also evident that from his surname and other facts, it was clearly to her knowledge that (her husband) was a Christian at the time of the marriage. It is too late in the day to contend that her consent to the marriage was obtained by fraud," said the court.

"Now Nilanjana cannot contend that Rajesh had concealed the fact from her that he was a Christian and therefore she is entitled to a decree of nullity on the grounds that her consent was obtained by fraud by concealing the fact that he was a Christian."

Zee News: Tutor acquitted in rape case in New Delhi

Tutor acquitted in rape case in New Delhi

New Delhi: A tutor accused of raping his minor student after administering her sedatives has been acquitted by a Delhi court which said the alleged victim is not a "credible witness".

Additional Sessions Judge Virender Bhat acquitted the man of the charges of rape, causing hurt by giving poison and threatening the victim, saying the conduct of the girl in accompanying the accused to some other places raises serious doubts about her version of the incident.

"In the instant case, I consider that the prosecutrix is not a credible witness as her testimony is in stark contrast to her statements recorded during the investigation. Her testimony is replete with embellishment and prevarications. It also does not inspire confidence," the court said.

According to the police, the girl's mother had lodged a case against the accused alleging that he had raped her in July 2012 in a house in Palam colony here after administering her sedatives.

Pay estranged wife for child's treatment: Family court

Tuesday, Jan 7, 2014, 8:51 IST | Place: Mumbai | Agency: DNA
A husband who questioned his estranged wife’s decision to treat their daughter at a private hospital has been asked
by the family court to reimburse the expenses incurred by her. “No comment can be passed on the choice of the
hospital as it was done in the best interest of the child. The husband should reimburse the cost mentioned in
those bills,” judge PL Palsingankar said.

The wife’s advocate said she spent Rs38,000 to treat her daughter’s tonsils. Apart from this, Rs1,100 was spent
for pathological and X-ray examinations, and Rs218 on medicines. The husband said he was willing to get her
daughter treated at Lokmanya Tilak (Sion) hospital. He even proved that he was paying Rs68,000 as her school
and tuition fees and Rs18,000 for other expenses.

The judge, however, noted the apprehension expressed by the wife, who said her estranged husband was not
paying maintenance regularly. “In such a situation, how can a wife have faith in her husband that he will take
the daughter either to Sion hospital or any other hospital?” Palsingankar said.

Times of India : Husband’s impotence amounts to cruelty: Court

Husband’s impotence amounts to cruelty: Court

Rebecca Samervel, TNN Dec 29, 2013, 06.19AM IST

MUMBAI: Observing that a husband's impotence amounts to mental cruelty, a family court granted a woman, a Malad resident, maintenance from her estranged husband.
"It is well settled law that if the respondent is impotent and the marriage has not been consummated, then it causes cruelty to the wife. Therefore, in this situation, mental cruelty is caused to the wife and on this ground, she is entitled to stay separate and claim maintenance," the court said.

The court granted the 19-year-old woman a monthly maintenance of Rs 3,500. Additionally, the man will have to pay arrears amounting to Rs 77,000 in six installments along with Rs 3,000 as costs of the litigation.
The woman, a housewife, who had filed a petition on February 6 last year, said she got married on May 22, 2010. But the marriage could not be consummated as the man was impotent. The woman confided in the man's sister and sought help. She also told her father who tried to help the man by getting him the best possible medical help. But the problem persisted and the marriage was never consummated.
The husband, eventually, deserted the woman on August 6, 2011, and did not pay her any money for her expenses. The woman claimed the man had a fruit business and earned Rs 25,000 every month. Stating that she had no source of income, the woman sought a monthly maintenance of Rs 5,000.
In the court, the man did not file his reply. The court said as he remained absent and failed to cross-examine the woman's version, her evidence remained unchallenged. It was proved that the man had neglected to maintain her though he had sufficient means to do so, the court added, observing that a monthly maintenance of Rs 3,500 would be just and reasonable.

BANGALORE: In an interesting case, the Karnataka high court has passed an order dissolving the marriage of a film producer citing that he has sufficiently proved the cruelty meted out to him by his wife.
"The making of unreasonable and unjustifiable demand for a separate house and a sum of Rs 20,00,000 in lump and Rs 20,000 as maintenance per month, the lodging of complaints on important dates, the dates or the previous day, on which the younger brothers of her husabnd were getting engaged and getting family members arrested and taken straight from marriage halls definitely amount to mental cruelty. The family court judge has not appreciated the evidence in right perspective," a division bench headed by Justice K L Manjunath has observed while ordering dissolution of the marriage conducted in Mysore in March 2006.

The husband, who had claimed that his wife kept on postponing the nuptila ceremony and had even asked him to undergo HIV test, which he underwent and was asked to undergo ELISA test and co-habitation was denied.
Interestingly, the wife had filed complaints against the family members either on the day or the previous day of the engagement ceremonies of the younger brothers of her husband and forcing them to take anticipatory bail in 2009.

Jagran : women leave husband escape with boyfriend

women leave husband escape with boyfriend 10719082

Merinews : Common 'Man' is so very vulnerable

Common 'Man' is so very vulnerable

It was a cool evening breeze flowing when I was standing and waiting for my friend to arrive, who called me a while back, that he will be coming to see me off. The pleasant weather, the cool evening breeze and the fact that I would be embarking on a journey for the next 2 weeks automatically made me hum some songs. And suddenly I saw an ugly looking female looking obnoxiously at me. She was of the impression I am singing it for her, whereas I had not even noticed her and nor was she noticeable.

But her 2 seconds look towards me sent a chill down my spine. I stopped singing and started thinking. I realized, this stranger female, who has nothing to do with me, carries the power to ruin my life and make me enter into any kind of negotiations with her at this moment. All she needs to do is complain against me saying that I was teasing her singing songs.
And the moment she did that, I would become a criminal. No one would listen to me or my side of the story and whatever story she utters becomes “evidence” for the case that would get filed against me. I would have to run behind courts and police stations, first to secure a bail, then to fight the case and to prove myself innocent for a crime I did not commit.
I would have to spend money behind lawyers, beg before unscrupulous and dishonest agents of the legal system, live a life of a criminal, and compromise my entire life at every step and all this because some obnoxious female did not like me singing.
My passport could be seized and I could be barred from leaving the country as well and for all you know I might also grace the headlines and suddenly the whole discussion would snowball into how “unsafe Women are” and how “bad Men are” and so on and so forth the story goes.
Reverse the situation, the woman humming a song and me complaining against her. Immediately, my counselling would begin trying to convince me that the woman’s intention was not bad, and do I consider myself a hunk or a stud that some female would sing songs for me and there would be complete invalidation, dismissal and mockery of my complaint let alone to say the emotional agony I would go through.
However, coming back to the current incident at hand, it sparks a train of thoughts in me,
1.    What have we done to the men in our society?
2.    How much vulnerable is the common man (the male) in the society?
3.    What kind of fear psychosis men are living in?
4.    How much undeserving power have we given to women in the society?
5.    Where are we heading to as a society?
And when, such is the situation, the statement made by Farooq Abdullah is completely correct and well-placed – “Men do fear of being jailed for talking to a woman”. I completely stand by him and only wish more and more men speak up. The only wrong thing he did was to apologize. There was no need for an apology. It’s high time women learn to take feedback and improve their behavior towards men. We are crossing limits of female pamperment,
The biggest culprit is the media and TRP hungry men like Arnab Goswami.
I want to ask Arnab, who is he to curb free speech?
A man has a right to express himself and Farooq just did that. Why penalize him for that?
Media has no business telling people what to say and what not to say. Their job is to report news; they better stick to that only.
Otherwise, the time is not far when people would stop respecting them. For example, Arnab Goswami, the way he has behaved on news hour on Times Now on 6th December 2013, he has lost the respect of many men in the country. He is now being looked upon as an arrogant, over-confident, non-listening editor who just wants to drive his own agenda in the show. There is a popular saying about Arnab Goswami, he thinks, “The nation wants to know, what he wants the nation to know”. He thinks, he can dictate the thought process of the society with his mannerisms and male hatred.
However, the day is not far when his show “The News Hour” would have a new anchor as Arnab’s high handed behaviour is turning out to be a liability for Times Now.
It's time that the media understands the warning - Mend your ways or pay the price. Stop imposing moral policing onto the society for reasons best known to you. Today, the male is vulnerable and this is the reality. And we all are responsible for this situation.
It’s not a surprise that slowly men will start drifting away from women in order to avoid false, baseless, frivolous and hazardous litigation and social shaming.
The lawmakers, judiciary and the police also have a lesson or two to learn. The famous cases of Tarun Tejpal, Justice A K Ganguly, and Shyam Rajak, the DD Official should act as eye-openers for them. The only solution to this problem is to start recognizing the need for men’s rights movement to be accepted as a mainstream movement and initiate the process of making all laws gender neutral.
Stringent laws will only convert innocent men into criminals and we will see many more Farooq’s asking men to stay away from women for safety. How many Farooq’s are we going to condemn, in order, to suppress such feelings?
Condemning men who express their feelings is a sexist anti-male attitude and should not be encouraged at all. Men must have an unfettered, unobstructed and un-criticized right to express their feelings and if men are complaining about women’s behavior then its time women change their behavior. Shaming and blaming men is not the solution.
This kind of social setup has made men extremely vulnerable and this is not a healthy society to live in. Things must change in the favor of men lest men despise society and women.

Merinews : Top 10 sexist languages that are anti-male in nature

Top 10 sexist languages that are anti-male in nature

Top 10 sexist languages that are anti-male in nature                02 January, 2014

Often we have heard about sexism in media and all of the sexism that we hear in media is one-sided; sexist language affecting women adversely. Till date we haven’t heard of sexist language that affects men adversely.

Yes, because we do have many such instances wherein sexist anti-male language has been uttered, propagated and accepted socially as well.
No, because mainstream media and society does not consider such language to be sexist. So, what is missing is the recognition of such anti-male language and the content as “being sexist”.
However, that does not change the fact that it is sexist and it also does not change the fact that it does hurt men. It’s just that inherently the society, including men, carries so much of internal bias against men that the need to call such a language sexist is not deeply felt.
And, by not challenging such sexist anti-male languages we are doing institutionalized disservice to men as a gender and as a clan and any society that speaks so much of gender equality, just cannot ignore such challenges.
Let us have a look at 10 such instances of language that is deeply sexist in nature and hurts men to the core, being anti-male in nature.
It is sexist,

1.    Calling a man loser: Often, we see incidences of men being called losers when they face adverse situation which is perceived as the man not being able to be a “real man”
or “man enough”. It is often used to provoke a man into doing something uncomfortable just to prove his “manhood”.

2.    Calling men as chauvinists: Often, when men try to put their point across, they are accused of being chauvinistic and it is an attempt to the silent the man so that he submits himself to feminist dogma.

3.    Chiding men with names: Men are chided with names like “biwi ka gulam” (slave of wife), “maa ka laadla” (mama’s boy), “nikamma” (useless fellow) etc., again in order to push them to extremes so that they keep working for people around them, often at the cost of their own likes and interests.

4.    Calling a man impotent: Often women tend to call their men as impotent, if they are not in the mood, neglecting the fact that he may be tired too. Ironically, society welcomes such behavior and joins hands in forcing the man to appease the woman disrespecting his personal space.

5.    Calling a man ‘commitment phobic’: When men aren’t comfortable in a relationship and want to discontinue it, they are called commitment phobic. This is again done to force the man to surrender his choice and bow down before the choice of the woman.

6.    Calling a man dominating: High performing men are often called dominating, when they are just assertive of their opinions arising out of their skills, expertise and confidence.

7.    Calling a man egoistic: Men are denied personal communicational space in the society and are often called egoistic while they are just bothered about others and want to solve their issues on their own, without discussing them.

8.    Calling a man insensitive: Men are often forced to apologize even without mistakes merely because women can’t take their comments in the right spirit and if a man takes a stand for himself and refuses to apologize, he is called insensitive.

9.    Calling a man misogynist: Men, whose opinions about women do not match with populist media opinions, are tagged off as misogynists and their voices are silenced. This is an attack on the right to free speech to a man.

10.  Calling a man lazy: Men are discouraged from cherishing their personal space by being named as a lazy fellow. Such socially validated language forces them to live a life on the edge and be on the run always, like a rat race, leading to severe health risks in men like increased blood pressure, increase cholesterol, high amount of stress, high rate of suicides, lower life expectancy, vulnerability to heart attacks, cardiac arrests, etc.

These 10 instances of sexist anti-male language are just the tip of the iceberg. These are the ones most commonly used to shame men, forcing them to adapt to ant-male social standards and throttle their own freedom of choices and choice of freedom. There are many more instances of anti-male language which are being propagated by the media and aren’t considered to be sexist.

Any language that penalizes a man because he is a man is sexist in nature and it is incumbently prerogative upon any sane society to disdain, condemn and eradicate such language.

False allegation complain from wife can lead to Divorce

Guilty if charged - Times Of India

Guilty if charged - Times Of India

Guilty if charged

Prem Shankar Jha Dec 22, 2013, 05.56AM IST

As I write, Tarun Tejpal, founder-editor of Tehelka and father of the sting operation in journalism, has been in a Goa prison for 20 days, 11 in police and nine in judicial custody. If the Goa police ask for an extension he may spend another 40 days in jail. At the other end of India, in West Bengal, Justice A K Ganguly, a former Supreme Court judge and currently chairman of the State Human Rights Commission stands accused of sexually harassing a young female intern while on a visit to Delhi.
Both the alleged culprits have stoutly denied the allegations . Tejpal has conceded that he went too far but did so because of a misunderstanding that arose out of a fairly prolonged period of consensual sexual bantering. Ganguly has rejected the allegations outright. But in the court of public opinion both men already stand condemned. Many reasons have been put forward to explain this: political vendetta ; unassuaged rage against the rape-murder of Nirbhaya a year ago; and the celebrity status of Tejpal. But at its root it springs from anger at the presumed abuse of a mentor-disciple relationship by the former.

What the prolonged and continuing abuse of women, both at home and work, has made public opinion overlook is that abuse can, on occasion, work both ways: that women can be attracted to powerful men, can feel betrayed when these men do not live up to their promises, and can accuse them of sexual molestation to exact revenge. The duty of the law must therefore be to distinguish the one from the other, for only thus can justice be done. This requires the gathering of evidence that will confirm or refute one of the two versions. It requires the media to refrain from rushing to judgement. In particular it requires lawyers to refrain from themselves breaching the sanctity of the judiciary and leaking court documents to prejudice the case against the defendant.
In the above cases these fundamental requirements of natural justice have been observed only in the breach. One is therefore forced to ask the question: what if the judges have come to the wrong conclusion ? What if Tejpal and/or Ganguly are telling the truth? What if the prosecution cannot furnish corroborative proof that they sexually molested, or made unwelcome advances to their 'victims' ?
The disconcerting answer is that it will not matter. In India, and several other countries where laws have been passed to punish crimes against women, the burden of proof has been consciously reversed: it is the accused who has to prove his innocence. This reversal is bad in principle, but probably necessary to create a level playing field for women in cases pertaining to sex crimes. But the new rape law has carried the reversal to a point where, if implemented as drafted, it will defeat the very purpose of justice . For once a man is accused, it leaves him with no way whatever of proving his innocence.|
First it expands the definition of 'rape' to include penetration by any object, to any extent. The latter part of this definition makes it impossible for the defendant to adduce medical evidence of the absence of penetration in his defence, for 'any extent' could be one millimetre or even less. This is reinforced by the absence of a prescribed time limit for reporting a sexual assault. In the Tejpal case, the victim made her first protest , in an email to the managing editor 11 days after the alleged act of penetration . After such a long period, medical evidence of even a far more substantial penetration would have been hard to find.
But this is only the beginning of the injustice enshrined in the law, for the prosecution does not even require medical evidence of forcible penetration to obtain a conviction. The new law says explicitly that 'lack of physical resistance is immaterial for constituting an offence' . The defence will therefore be unable to plead this as proof of consensual sex.

What happens when there is no evidence of molestation or rape, but the plaintiff swears in court that she was coerced? The answer is that the new law requires the judge to believe her. He must base his verdict upon the premise that, in matters pertaining to sex, women cannot lie under oath!
The new act has even blocked the defendant's last line of defence — to allege that the plaintiff has a record of indulging in sexual innuendo or conferring sexual favours upon men, stating explicitly that 'the character of the victim is irrelevant' . It has also expanded the definition of sexual assault to include not only 'physical contact and advances involving unwelcome and explicit sexual overtures' but even a verbal demand for sex. This clause has made even a mention of sex to a woman a dangerous liberty that can send a man to prison.
To call the new law 'draconian' would be an understatement , for what it has done is to fuse accusation and verdict: once you have been accused, you are automatically guilty. This is what the Inquisition did in Spain, and the Salem witch hunt in the US. The new rape law is about to make India a member of this inglorious club.

Wife's unsubstantiated allegation of infidelity against husband is crueltyu: HC 10598738

Merinews: How the elderly parents are suffering because of gender biased laws in the country

How the elderly parents are suffering because of gender biased laws in the country

This is an effort to understand the pain and agony of elderly parents who are bound to see their son's life ruin and are unable to help even if they want to. Thanks to gender biased laws in our Great Country. Thanks to all law makers and feminists who made our respectable senior citizen's life miserable.
An elderly couple writes to Police, NHRC and all relevant departments:

Dear Sir/Ma'am,

With due respect I would first like to introduce myself. My Name is Chandera Shekhar (Name Changed) aging 69 Yrs and my wife Smita Shekhar (Name Changed) aged 63 years. We are respectable senior citizens of our country with deep roots in the society.

We have a son ageing 36 yrs, he was married to Ashmita (Name Changed) in New Delhi with no pomp and show. It was rather a small family affair which included just 12 members of our family. Everything was fine for couple of months. Then she left our son and went to her parents' place on 29th June 2012 and she has been at her parental place since then.

Later she made a fake and frivolous complaint in CAW cell regarding Dowry demands. We have been regularly abused, mentally harassed and are being deprived of meeting our grand daughter.

Below mentioned letter was written by our son:

This is in regards to the complaint filed by my wife which is under your kind Investigation / Enquiry. In last session 17th Oct 2013, you had advised both of us to make another effort for reconciliation, I appreciate your kind gesture. I also informed you that my wife does not picks up my calls so you had advised my wife to pick up my calls and also, that if she does not pick up my call I should let you know.

I, as per your advice, called my wife on 18th October, she did not pick up my call. 19th again I called, she picked up but disconnected the call. 20th I called her, she picked up, I requested her, that 22nd Oct 2013 is Karwa Chauth and I wish to spend the day with her and also that I intend to go to her parental place where she is residing at present for the said occasion.

At first she said she does not know if she would be fasting that day or not. Later when I insisted her to tell me she said, she would fast that day. I told her that I would want to come to her place for the day, in reply she said: “Kya karoge aa kar, koi zaroorat nahi hai aane Ki” Mai shayad fast rakhu bhi na, tumhe mere ghar aane ki koi zaroorat nahi hai.

Another effort of mine was wasted, I had also agreed to her unethical demand of me leaving my elderly parents and was ready to move to Delhi. I had also given her two Plan of actions and advised her to choose which ever suits best to her unethical demands for reconciliation in front of you on 17th Oct 2013.

Still she is not showing any interest in reconciliation, and is asking you to register FIR ASAP, after the session in your CAW cell, she said “Ab apni beti ka naam mat lena kabhi, mai tumko us se milne bhi nahi dungi”.

This attitude of her is creating serious doubts of her reasons and intentions for approaching your CAW cell, and gives an impression that she filed the complaint based on wrong, incorrect, and false facts as the same is sheer abuse of the process of law and same is filed with malafied intentions to harass, pressurize and with a sole reason of extortion.

I don’t see a reason why she would deny me joining her for Karwachauth and don’t see a reason why she is not ready to accept my plan of action for reconciliation now, when since first day of her complaint she was adamant that I should leave my elderly parents and relocate to Delhi with her.

I would kindly request you to please take above mentioned act of her in consideration and question her as to why she is harassing me and my family with this false and frivolous complaint and depriving me from meeting my Daughter.

This complaint of hers is a classic example of rampant misuse of 498A, as I informed you in the last session that my wife herself admitted on 6th Aug 2013 that all her allegations are false and frivolous and based on assumptions and on her father’s words of mouth. I can prove that as well.

As a result of her unethical behaviour and if she had already decided that she would ruin our daughters life by not letting her meet her father, now I deny to give up on her unethical demands and don’t care if her false complaint turns out into FIR. I will now not leave my elderly parents and will fight for Justice till the end.

Our Daughter in law has always been given due care, love and respect which she truly deserved. There was no issues what so ever between our son and our daughter in law and they were leading a peaceful life, until my sons mother in law, his father in Law and our daughter in law’s maternal uncle started interfering in their matrimonial life and who proved themselves an instrument to disturb the matrimonial life of our Daughter in Law for reasons best known to them.

Thus in view of above stated facts, I would kindly request you to please assist us in reconciling our sons matrimonial life with his wife in the best interest of his daughter at his native place only. So that our son could look after us at this stage of life. We are the respectable senior citizens of India request your kind intervention in this matter and kindly save us from this mental harassment.

Me and my wife are elderly and cant handle such extreme torture and cant accept the fact that our son is being named in a false and frivolous complaint. We are on a verge of giving up and if not helped would request you to please grant us mercy killing for both of us.

Questions: Forget about their son, but who is responsible for the traumatic situation this elderly couple are in? Does anyone even care for them? Is there anyone who would listen to them? Is there anyone who would intervene and make their life easy so that they can lead their remaining days with peace and with happiness along with their grand daughter? Why at the first place they were in a situation where they had to ask for mercy killing?

India Today : Govt to compensate victims for wrongful implication by police

Govt to compensate victims for wrongful implication by police

Ayesha Arvind   |   Mail Today  |   New Delhi, December 27, 2013 | UPDATED 10:39 IST

The police as well as the government will now have to pay a heavy price if any innocent person is wrongly implicated in any case, including those of sexual assault and terror cases.

The Supreme Court has said that "the people who are framed up are also victims of crime and hence, the authorities are obligated to pay compensation to them for agony and harassment."

Parvez Ahmad Radoo was falsely branded as a terrorist by the Delhi Police
Sending across a message loud and clear on zero-tolerance against wrongful implication, the SC order has come following a trial court verdict of Additional Sessions Judge Kamini Lau whereby, she said that every person framed was also a victim of crime and hence state agencies must cough up adequate compensation to make up for its blatant abuse of power and the loss of reputation of the victim.

Lau was hearing a matter involving four youths who spent considerable time in jail because of false charges followed by a police probe full of lapses.

'Victims of crime'

On January 29, 2010, four youths Dalip, Deepak, Ravinder and Vikas were arrested by the police and charged with offences of robbery and attempt to cause death or grievous hurt. The police officials, posted with the Jahangirpuri police station, claimed that at around 5 am, they found the four accused running and another person, identified as Nitin, following them.

Nitin informed them that the four persons had robbed him of his wallet and mobile phone and also threatened to kill him. The police arrested the four and charged them under sections 392, 397, 411 of the IPC and the matter was taken up by a court. However, during the proceedings, Nitin, testified that he had given a false testimony against the four at the behest of a businessman.

The court then directed the Crime Branch to inquire into the case and it was revealed that the four had been falsely implicated and that the police failed to discover it during its probe. In the meanwhile, the four had already spent a "considerable time" in jail, the court noted.

Lau also said "serious constitutional and human right violations" had been observed in the case since all the accused had no past criminal record, and yet had to suffer detention and trial for an offence they didn't commit.

Considering rampant cases of abuse of power by the police and the state, and citing previous Apex Court orders, she said it was necessary to educate ourselves into accepting that respect for rights of individuals was a true bastion of democracy and "therefore, it was necessary for the State to repair the damage done to the citizens."

The court ordered a compensation of Rs.50,000 to each of them. While accepting that a serious "lapse" had been committed, the police and the state opposed the compensation saying that the court had no jurisdiction over it.

The police approached the Delhi High Court, against ASJ Lau's order. The HC however, junked the appeal, and upheld the trial court ruling. The officials then approached the SC that has now dismissed the same and approved the trail court verdict.

'Deed of Divorce' not valid, but mutual divorce can sustain:HC | Business Standard

'Deed of Divorce' not valid, but mutual divorce can sustain:HC | Business Standard

Press Trust of India  |  Mumbai
Last Updated at 11:40 IST

Observing that divorce cannot be sought by spouses through a deed, the " target="_blank">Bombay High Court has set aside a family court order which rejected a petition filed by a couple seeking divorce by mutual consent by waiving the 6-month mandatory waiting period for granting such relief.

The couple, Mittal and Manoj Panchal, got married in April 2007 in as per Hindu rites but within a year disputes arose between them due to incompatibility, inequality and differences in their thoughts.

Source : http://www.business-standard.com/article/pti-stories/deed-of-divorce-not-valid-but-mutual-divorce-can-sustain-hc-113122900150_1.html

They decided to get separated and mutually decided to execute a 'deed of divorce' in June 2011. At that time, they were not aware that such a divorce was not recognised in . Both got re-married and the wife applied for a visa as her second husband was settled there.

However, she could not get visa as the US Embassy demanded a divorce decree from the court. She then sought help of her first husband who cooperated and both applied to the family court under section 13-B of Hindu Marriage Act to get a divorce by mutual consent by waiving off the mandatory six-month waiting period.

The family court rejected their petition following which she approached the Bombay High Court.

A bench of High Court headed by Justice V K Tahilramani recently ruled, "We are of the opinion that the impugned order (of the family court) is not sustainable, both on facts and in law."

The family court primarily rejected the petition on the premises that the marriage between the appellants was already dissolved by the Deed of Divorce dated June 13, 2011, as per the custom and usage prevailing in the caste and community and, therefore, the petition filed under section 13-B of Hindu Marriage Act is not maintainable.

The family court also held that the deed of divorce, being an agreement between the appellants, cannot be set aside except on the ground that it was executed under force or pressure or by fraud by the parties to the agreement.

The High Court held that the reasons given by the family court in rejecting the petition were not legally sustainable.

The bench said the decree of divorce should have been passed because the marriage had been solemnised and later the parties had separated and mutually agreed to a divorce.

Jan 1, 2014, 02.21PM IST

Dainik Bhashkar :

bhaskar news | Dec 22, 2013, 06:17AM IST

Times of India : High court stops NRI from seeking divorce in US

High court stops NRI from seeking divorce in US

TNN        | Dec 31, 2013, 11.54 PM IST

NEW DELHI: The Delhi high court has come to the rescue of a woman allegedly deserted by her husband who has filed for divorce in the US.

In a recent ex-parte order, Justice Mukta Gupta restrained the husband from proceeding with the divorce petition filed in a Texas court. She took into account that the couple had tied the knot in India and now the woman doesn't possess a valid visa to travel to the US and contest the divorce plea.

"The balance of convenience lies in favour of the wife and if injunction isn't granted, she will suffer irreparable loss," Justice Gupta said.

HC accepted the argument of the woman's lawyer, Prabhjit Jauhar, that since they were married in India in accordance with Hindu Marriage Act, 1955, their marriage could only be dissolved under the provisions of the Act. He further said the US court has no jurisdiction to resolve the marriage.

According to the petitioner, she was suddenly left stranded by her husband who filed for divorce in the US on the ground of irreconcilable differences. She told the court that soon after their marriage, they left for the US. While initially the husband was staying in a rental accommodation, the couple shifted to a home they had purchased.

Their relationship turned sour when the husband and his parents started treating the woman with cruelty and demanded that her parents transfer one of the properties in the name of the husband. When the woman's parents pleaded helplessness, the husband allegedly conspired with his parents to oust the woman from their house.

HC was further told by the woman's counsel that she was sent back to India for a holiday with a return ticket to the US. But, once she was gone, the husband did not apply for her green card because of which the woman's dependent visa expired. In her absence, the husband got his green card and filed the divorce petition.

PuneMirror : Do not demonise dad

Do not demonise dad

While women refuse to let ex-husbands visit their children, equal parenting rights is what many city men are battling for

Posted On Wednesday, January 01, 2014 at 08:42:44 AM

The recent Family Court circular that orders women to let ex-spouses visit kids must come as a welcome move for so many young fathers. The court statistic says that as many as 75 per cent of women in over a thousand divorce cases refuse to let ex-husbands visit their children, even if they have agreed to do so in the terms of the divorce.

These are not men with any kind of abusive, neglectful or other unfatherly traits in them. Many of them are victims of vengeful and deceitful stances taken by their ex-wives and the exwives’ families, well after the divorce is in place. The maturity and understanding needed to not continue the battle between the divorcing parents in a way where the children become pawns, seems absent from many of these women and from the legal and familial advice that they get.

Fathers on the other hand are advised routinely to either ‘let it go’ as there is no point in pushing for your rights and further alienating the ex-wife and being turned into a further villain in the eyes of the child. Or some are advised to insist on taking the child for a visit by taking a policeman with them, etc. The choice for men in these situations seems to be between the devil and the deep sea.

Either watch your child being alienated from you and its paternal grandparents, or put on a tamasha just to have the child come visit, and risk being labeled abusive, dangerous, a threat, etc.

Very soon, the father gets demonised in the eyes of the child, and the mother then declares that the child is refusing to go visit the father. It’s a lose-lose situation for the father and his family, and a much larger tragedy for the child who is brought up to believe that the father is persona non grata, or worse, ‘was just not bothered about you when you were growing up’.

Up until now, those fathers who have given up on any healthy regular interaction with their children sometimes can only hope that when the child is old enough to ask some real questions, he or she may try to seek out the father…but that is only much later, after many years have passed.

By then, the disconnect is huge, and the way back to each other is often awkward and painful. While the new order is most welcome news, as in all things Indian the mechanics of how exactly the order itself can be carried out effectively is something that is not clear. Even now, would a father have to still storm in armed with a court order, to take his child for a visit?

Would that not keep things as unfairly loaded against him as before? The mechanics of refusal, from what many fathers have experienced, is very easy for any mother who wishes simply not to let the two meet in any sustained or meaningful way. The excuses are plentiful and frustrating. “He is not well.” “Today she has gone for a class outing.” “She says she is scared of you.” “She says it is boring in your house.”

The list is long. The other subtle pressure comes from mothers or maternal grandparents quizzing the child when he or she returns from an outing with the father, in such a way, that the child feels guilty and disloyal for having had a good time, or for looking forward to the next outing.

Many women are deeply insecure and defensive about what the child will tell the other parent or grandparent about the mother, or are afraid of the ex-in-laws poisoning the child against its mother on such visits. While in some cases this may be true, it is simply not the case many times.

The answer is not in refusing to send the child at all, but in negotiating what areas of conversation are simply a no-no with a child, in both homes. Some couples have managed to find a balance, thereby insuring that some modicum of stability and unambiguous access to both parents is restored in the child’s life.

To quote from a recent Pune Mirrorreport, “Disputing parties need to embrace an integrated approach, keeping in mind the mental and emotional wellbeing of the child. Also, there are guidelines on child access and custody laid down by the Bombay High Court in 2011 that clearly place both natural guardians on an equal footing, placing paramount importance on the child’s welfare,” says Mahesh Shinde, president, Men’s Rights Association.

While women have had to battle hideously unfair situations in divorces, surely the time has come to look at the silent suffering of many of our city’s divorced fathers.

Girls caught with lovers file rape case after being caught: Court

New Delhi: A man accused of raping a woman by deceitfully making her believe that she is his legally wedded wife has been acquitted by a Delhi court which said girls voluntarily elope with their lovers but to escape their parents' scolding they lodge false case.
"They (girls) voluntarily elope with their lovers to explore the greener pastures of bodily pleasure and on return to their homes, they conveniently fabricate the story of kidnap and rape in order to escape scolds and harsh treatment from the parents.
"It is these false cases which tend to trivialize the offences of rape and undermine its gravity. A girl of this age group (19 24 years), even if belonging to a rural area, cannot be believed to be not knowing how the marriage is performed or what are the essential ceremonies of a marriage," Additional Sessions Judge Virender Bhat said.
Girls caught with lovers filing false rape cases: Court

The Delhi court observed that false cases tend to trivialize the offences of rape and undermine its gravity.

The court's observation came while deciding the case of a man accused of raping his relative who had come to his house to take care of his pregnant sister-in-law (victim's sister).
The police said that in 2008, the accused in collusion with his brother, had taken photographs of the alleged victim in objectionable position with him to blackmail and pressurise her not to take any legal action against him.
When the 24-year-old woman pressured him to fulfil his promise of marriage, he took her to Jammu on the pretext of marrying her and applied vermilion on her forehead and made her believe that she was his wife, the police said.
He maintained physical relations with her by making her believe that they were husband and wife. The accused had also assaulted the girl, the police added.
The court, however, said this kind of marriage is usually resorted to when the boy and girl are in love with each other and their respective parents are against their alliance.
"The conduct of the girl in accompanying the accused to Jammu for court marriage demonstrates that she wanted to marry the accused but her parents were against this marriage. Her longing to marry the accused appears to be only out of deep love and not on account of assurance of marriage by the accused," the court added while acquitting the man.
The court also said that of late it has observed a trend where the girl says the boy took her to a room, applied vermillion on her forehead, put garland around her neck and declared that they are now husband and wife.
"Then they indulge in sexual intercourse with each other, with the consent of the girl and later on the girl alleges rape on the false assurance of marriage. This is a very disturbing trend. The girls in such cases are mostly in the age group of 19 24 years, thus mature enough to understand the consequences of their acts and not so numb to get carried away with any representations of the boy," the court said.
During the trial, the man had denied all the incriminating facts and circumstances put against him and had claimed he was falsely implicated.
