KOLHAPUR: In its first year of functioning since March 1, 2013, the family court in Kolhapur had received 1,293 cases and resolved 686 of these, including 509 civil cases and 177 criminal cases.
At the time of the formation of the Kolhapur family court, 773 family cases were being heard by the district and session courts. From March 1, 2013, all these cases were transferred to the family court. In the subsequent months, the family court received 520 fresh cases. The family court resolved 686 of these, while 607 cases remain pending. Of the 520 cases the court had freshly received, 416 were civil cases, while the rest were criminal cases.
Sixteen cases were resolved through counselors, while 22 were resolved through mediation.
The court exercises jurisdiction over residents of the Kolhapur Municipal Corporation, with a total population of half-a-million. It handles cases pertaining to disputes between married couples, maintenance, right to the husband's property and custody of children, among others.
Establishing the family court in Kolhapur was a step forward to ensure cost-effective, timely legal resolutions to family disputes. Nearly 800 cases have been transferred to the family court from other courts in a year's time. Earlier, such cases were heard before the regular courts, resulting in major inconvenience for couples and families.
Marriages registered under the Hindu Marriage Act and Special Marriage Act and marriages under acts of other communities and religions are also accepted and heard in the family court. Cases of domestic violence have been addressed.
In its one year of functioning, the court had received a higher number of civil cases and complaints than criminal cases.
It had received 233 cases related to couples seeking divorce, while 94 cases of divorce with mutual consent are pending before it. The court also observed that from January 1, 2014 to February 28, 2014, it received 112 cases - a figure translating into almost two cases per day related to dispute between couples.
In one year, the court had heard 155 cases of wives seeking maintenance from husbands and 127 cases of recovery of maintenance.
In a few cases, the families of the husband or the wife have approached the family court complaining that other party had hidden some inconvenient facts or had presented misleading information.
